The Insurrection Act Has to Go - The New York Times

Some version of the Insurrection Act is probably necessary. The authority granted by the act, however, is remarkably broad, and oversight is virtually nonexistent. The Insurrection Act contains a number of provisions, and not all are equally bad. But the act gets worse, much worse. You might wonder why the Insurrection Act hasn’t presented much of a problem before now.

It also is one of the most substantial exceptions to the Posse Comitatus Act, which generally prohibits using the military for law enforcement purposes. Trump has spoken openly about his plans should he win the presidency, including using the military at the border and in cities struggling with violent crime. His plans also have included using the military against foreign drug cartels, a view echoed by other Republican primary candidates such as Florida Gov. The threats have raised questions about the meaning of military oaths, presidential power and who Trump could appoint to support his approach. William Banks, a Syracuse University law professor and expert in national security law, said a military officer is not forced to follow “unlawful orders."

A heavy irony hangs over Michael Richards’s work: The artist known for images of pilots, airplanes, wings and targets died, age 38, in the Sept. 11 attacks. He had spent the night in his studio on the 92nd floor of the World Trade Center’s north tower. But it’s likely that, had he lived, we would still be discussing Richards’s sculpture. In his handful of active years, he was beloved by curators and peers, and found consistent institutional support. Dread Scott, an artist and friend of Richards’s, recalled their conversations ranging over “W.E.B.

The special prosecutor, Lawrence Middleton, had secured convictions in a 1993 federal trial against Los Angeles Police Department officers for beating Rodney King. (“Both officers’ use of deadly force was reasonable under the circumstances,” Ms. Lacey wrote in a 2019 memo.) The re-examinations themselves take time, and liberal prosecutors may yet file criminal charges against more officers in past cases. The police had responded to a call that Mr. Gonzalez, 26, was acting strangely in a park and talking to himself. The officer, Hector Jimenez, was cleared in each case and remains with the Oakland Police Department.

Kevin Lambert grew up in North Carolina in the 1980s, and first visited his mother's native South Korea in 2000. Courtesy Kevin LambertIt might seem an odd desire given many have never set foot in South Korea. But life in South Korea brings its own challenges – and many eventually return to the US. For Kim, it’s a relief to be back in South Korea, where the safety is “100% better.”“I plan to live (in South Korea) until I die,” he said. “If South Korea today was as impoverished as it was when I left, why would I return?” he said.
OUR MIGRANT SOULS: A Meditation on Race and the Meanings and Myths of “Latino,” by Héctor Tobar“Our Migrant Souls,” the new book by Héctor Tobar, begins with a direct address to the many Latinx students he has taught during his years as a professor at U.C. His tone is gentle and tender as he recounts the stories they’ve shared with him in essays and office visits — stories of migration and homecoming, trauma and resilience, doubts and joys. “You are a deep brown and you are fair-skinned,” he writes. “Your eyes are black and they are green, and you are 19, and 20 and 21.” Tobar describes a multitude of young people navigating complex ancestral histories and shifting notions of identity. “I will weave what I know with what you have taught me,” he promises them, “and together we will arrive at an understanding of our times, and our ‘people.’”Tobar, who has spent several decades reporting on immigration, culture and Latin America, is well equipped for such a task.
Police officers involved in the deaths have become an intense focus of investigation, protest, and media coverage. Despite being at the heart of some of the most defining incidents in modern policing, most of the officers involved continue to live their lives under the radar. Insider's review of 72 cops involved in two dozen of the most notorious police killings of the past 30 years shows the many different paths officers have taken. There's no nationwide view into what happens to officers involved in egregious incidents of violence. In rare cases, cops involved in these killings have tried to publicly rehabilitate their image rather than seek out anonymity.
The Detroit Pistons played the Dallas Mavericks Monday night, and were unable to leave Dallas due to icy conditions. NBA games have rarely been postponed due to weather in recent years compared to the number of games missed due to COVID outbreaks. However, the team — still stuck — was forced to return to their hotel after seven hours at the airport. The game was later postponed, according to ESPN. Over the course of the pandemic, NBA games routinely were postponed or canceled due to COVID outbreaks among players.
“This will not be easy for anyone,” CNN anchor Erin Burnett said before playing the footage for the network’s audience. In such cases, often a decision is made to run the graphic footage in an uncensored manner for a limited time, before later airing more limited clips of the incident. Just hours before the release of the Nichols footage, graphic video capturing the grisly attack on Paul Pelosi, the husband of former House Speaker Nancy Pelosi, was also released to the public. “We had no idea what that was going to look like and that should have had a warning and a graphic warning before we showed it and then on screen,” Faulkner said. Content warnings were applied stressing to audiences that the footage was graphic in nature.
Rodney King's daughter weighed in on the fatal beating of Tyre Nichols earlier this month and the triggering parallels it draws to the brutality her father suffered at the hands of police officers more than 30 years ago. "People wonder where the anger comes from, this is where," Lora Dene King, 38, told NBC News. In 1991, video of Rodney King being mercilessly beaten by Los Angeles police officers went viral, prompting public outrage and leading to criminal charges against four officers. Lora King, 33, daughter of Rodney King, at her home in Los Angeles in 2017. Of all the things Lora heard about Nichols in the news, one thing stood out to her: his love of skateboarding.
Wells warned of the contents of the video, called it "horrific," and asked people to protest in peace after its release. Crump has said it reminded him of “the Rodney King video,” referring to the 1991 bystander video of Los Angeles police officers beating a Black man. Two of the officers, Mills and Smith, posted $250,000 bond and were released late Thursday. Haley, Martin and Bean had remained in custody Thursday night, jail records showed. “I expect you to feel what the Nichols family feels,” she said.

The Nichols family legal team has likened the assault to the infamous 1991 police beating of Los Angeles motorist Rodney King. Security camera footage shows three officers surrounding Nichols as he lies in the street cornered between police cars, with a fourth officer nearby. The body camera footage shows a first-person view of one of them reaching down and tying his shoe. The footage shows a number of other officers standing around after the beating. During the traffic stop, the video shows the officers were "already ramped up, at about a 10," she said.
MEMPHIS, Tenn., Jan 27 (Reuters) - The police department in the city of Memphis was set on Friday to release body-camera video of a violent confrontation between a Black motorist and five police officers charged with murder in his death earlier this month. Nichols succumbed to injuries he sustained from his encounter with police and died while hospitalized on Jan. 10, three days after he was pulled over while driving. The last words heard on the video were Nichols calling out for his mother three times, Crump said. Two members of the Memphis Fire Department involved in the response have been relieved of their duties pending a separate inquiry. PUBLIC OUTRAGE EXPECTEDAdditional Memphis police officers remain under investigation for policy infractions, Police Chief Cerelyn Davis said on Thursday in a message posted to YouTube.
Five former Memphis, Tennessee, police officers are in custody in connection with the death of Tyre Nichols, jail records show. They “were found to be directly responsible for the physical abuse of Mr. Nichols,” Davis said in a video statement Wednesday night. A "confrontation" followed, the department said at the time, and officers pursued Nichols when he fled on foot. Tyre Nichols in the hospital. Five Memphis police officers were fired in connection with a traffic stop that led to the death of Tyre Nichols.
In a video statement, Memphis Police Chief C.J. The five officers terminated last week "were found to be directly responsible for the physical abuse of Mr. Nichols," Davis said. “I expect you to feel what the Nichols family feels,” she said. Authorities have provided few details about the stop that led to Nichols’ death. A forensic pathologist hired by Nichols' family found he “suffered extensive bleeding caused by a severe beating,” a lawyer for his family said Tuesday.
The five officers have been charged with second-degree murder, aggravated assault, aggravated kidnapping and official misconduct, Mulroy said. Other Memphis officers remain under investigation for policy infractions, Memphis Police Chief Cerelyn Davis said on Wednesday. "I expect you to feel what the Nichols family feels. The Nichols family viewed the police footage on Monday with their attorney, Ben Crump. The last words heard on the video were Nichols calling for his mother three times, Crump said.
One of five former Memphis, Tennessee, police officers accused of fatally beating 29-year-old Tyre Nichols during a traffic stop this month was accused in 2016 of participating in a prison assault that left an inmate unconscious, according to a federal civil rights complaint. The officers accused him of flushing “contraband” after they saw smoke in the area where he was, according to the suit. Sledge accused Haley and another officer of punching him in the face, according to the suit. The Shelby County Division of Corrections did not respond to a request for comment Tuesday night. The Shelby County medical examiner's office has not released an official cause of death.
Rodney King's daughter is sickened by beating of Tyre Nichols in Memphis. Lora King says the race of the 5 officers involved in Nichols' beating is irrelevant. On Monday, law enforcement officials allowed Nichols' family and their lawyers to privately view body-camera footage of Nichols' arrest. In the wake of the killing, attorneys for the Nichols family compared his beating to that of King's.
